II. Formal Takedown Notice Requirements: The DMCA Framework

If you believe that your copyrighted work—including but not limited to textile patterns, hosiery photography, unique product descriptions, or proprietary sock designs—has been utilized on the Managets platform without proper legal authorization, you or your designated agent must submit a formal written notice. To be effective under the DMCA, your notice must include the following mandatory elements:

  • Identification of the Copyrighted Work: A sufficiently detailed description of the work you claim has been infringed (e.g., “Original Knit Pattern for the Arctic Merino Series”). Providing a USCO registration number or a link to the original work is highly encouraged.
  • Specific Location Mapping: The exact URL(s) on our website where the allegedly infringing sock image, design, or text is located. General site homepages are insufficient for Managets to identify specific assets.
  • Claimant Contact Information: Your full legal name, physical mailing address, telephone number, and a verified professional email address.
  • The “Good Faith” Statement: A clear statement that you have a “good faith belief” that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • Perjury Statement: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Formal Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
III. Internal Audit & Expedited Action Plan

Upon receiving a notification that complies with the technical requirements of the DMCA at our Palmer, AK headquarters, Managets will initiate the following response plan:

  4. Repeat Infringer Protocol: Managets maintains a strict policy of terminating the accounts of partners or contributors who are found to be “Repeat Infringers.”
IV. Counter-Notification Rights & Material Restoration

If you believe that your product design or image was removed by mistake or misidentification (e.g., you own the rights or have a valid license), you have the right to submit a Counter-Notification to Managets.

A valid Counter-Notice must be sent to support@managets.com and must contain your contact details, identification of the material that was removed, and a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Cautionary Legal Notice: Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material or activity is infringing may be subject to liability for damages, including attorney’s fees incurred by Managets. Submitting a false DMCA claim is a serious offense that Managets monitors closely to protect our brand’s integrity.
